My client is a has over 30 years' experience as a trusted law firm within the UK, they are leading providing of remortgage and property services. They have a fantastic and rare role for an experienced Property Litigation Solicitor / Lawyer.

The role:

To manage efficiently and profitably, specialist residential property litigation cases acting primarily for well-known residential mortgage lenders to enforce the terms and conditions of mortgage contracts and to perfect the registration of security that has not been registered correctly at HM Land Registry

Role Specific:

  • To conduct without the need for close supervision complex repossession litigation and title rectification matters on behalf of residential mortgage lenders, including those for example where greater risk is involved, unusual non-standard problems or where issues develop or where an error has been identified
  • To perfect lenders security, typically in scenarios where a legal charge has been discharged in error or has not been registered upon completion of a transaction
  • Sound knowledge of the relevant law and procedure is required including, for example: mortgage arrears, breach of mortgage covenant, mortgaged leasehold properties, ground rent & service charge issues and tie in to mortgage repossession work, similarly forfeiture, LPA receivership exit strategy and related issues and ancillary areas of law such as residential landlord & tenant repossession cases, deceased borrower cases, service out of jurisdiction, trespass claims, insolvency and disclaimers within the context of repossession litigation, enforcement including warrants of restitution, orders for sale, preparation for hearings and trials, making appeals and responding to appeals
  • Consider contractual mortgage terms & conditions and title documentation to advise lender clients on the merits, strategy and estimated costs outlay to achieve departmental targets
  • Working knowledge of HMLR practice guides and procedures to ensure applications for title registration and any requisitions are dealt with in an accurate and timely manner

The Candidate:

To be considered for this role it is essential that you are a Qualified Solicitor or FCILEx with a good working and technical knowledge of property law. Previous residential repossession litigations and title rectification experience at an advanced level and the ability manage a caseload. You will have excellent communication skills both verbally and written as well as organisational skills.
